Terms & Conditions for 3D Scanning Services

These terms outline the responsibilities of both parties when booking 3D scanning services with Images for Industry.

Scope of Work

Images for Industry Ltd (“the Company”) provides 3D scanning and virtual tour creation services using the Matterport Pro3 camera system. The objective is to capture detailed and realistic representations of existing environments, supplying clients with visual and spatial documentation of current site conditions.

Site Readiness and Client Responsibilities

The Client is responsible for ensuring that the site is fully prepared and accessible at the agreed time of scanning. This includes:

  • Clear and unobstructed access to all areas scheduled for scanning;
  • All necessary permissions, safety clearances, and site escorts arranged in advance;
  • A clean and safe working environment free from unnecessary clutter, people, or disruptions.

Cancellations or changes within 24 hours of the scheduled scan may be subject to charges.

  • Cancellations made more than 24 hours in advance will incur no penalty.
  • If the site is not adequately ready or accessible on the day, and scanning must be abandoned, the Company reserves the right to charge 50% of the quoted fee to cover time, travel, and preparation costs.
Lighting and Environmental Conditions

The Client must ensure that all relevant lighting is functional and switched on prior to the scheduled scan. Poor lighting conditions may negatively affect scan quality, colour accuracy, and final presentation.

The Company is not responsible for adjusting lighting, rearranging furniture, clearing clutter, or removing rubbish. If such preparation is required, it must be explicitly agreed in writing prior to the scan and may be subject to additional charges.

Client Responsibility for Verification

It is the Client’s sole responsibility to review and verify all deliverables for accuracy, completeness, and relevance to their intended use. The Company disclaims all liability for decisions made or losses incurred based on the data provided, including but not limited to measurements, point clouds, and virtual models.

No Liability for Environmental or Third-Party Factors

The Company shall not be liable for inaccuracies or issues arising from:

  • Environmental conditions such as lighting, reflective surfaces, or weather that may affect scan results;
  • Obstructions present during scanning, including furniture, equipment, or people;
  • Inaccessible areas or zones not made available at the time of the scan;
  • Any misinterpretation or misuse of the digital assets by the Client or third parties.
Equipment-Based Accuracy Disclaimer

All scanning is performed using the Matterport Pro3, a high-resolution 3D camera system with an accuracy of ±20mm at 10 metres under ideal conditions. The Client acknowledges that actual accuracy may vary due to factors such as environmental conditions, material reflectivity, and line-of-sight obstructions. While the Matterport Pro3 is suitable for survey-grade documentation, it is the Client’s responsibility to validate all data against their own standards or project requirements before making decisions based on the outputs.

Force Majeure

The Company is not liable for any delays or failure to deliver services due to events beyond its control, including but not limited to extreme weather, site inaccessibility, illness, civil disturbances, or power outages.

File and Data Delivery

Deliverables are provided digitally via secure online transfer. Clients are responsible for promptly downloading and backing up all received files. The Company cannot be held responsible for loss or corruption of files once successfully delivered.

Data Ownership and Confidentiality

Upon full payment, all scan data and outputs are the property of the Client, who may use, share, or distribute them at their discretion. The Company does not impose any restrictions on redistribution or reuse of the material. Confidential information contained within scans is protected by the security of the Matterport platform and account login protocols.

Limitation of Liability

Except to the extent that any losses or claims are caused by any negligence or recklessness on the part of the Company, the Company shall not be liable for indirect, incidental, or consequential losses. Nothing in this clause shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be legally limited or excluded.

Governing Law

These Terms are governed by the laws of England and Wales. All disputes arising hereunder shall be resolved exclusively in the courts of England.

Hosting and Renewal

All 3D virtual tours and associated assets are hosted free of charge for the first 12 months from the date of delivery. Continued hosting beyond the initial year will be subject to an annual renewal fee, which will be advised in advance of the renewal date. The Company reserves the right to remove or archive tours that are not renewed.
